Terms and Conditions Online Trading

Manx Museum and National Trust trading as Manx National Heritage.

Manx National Heritage sell our products to you subject to these terms and conditions listed here. By using our website, you show your agreement to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions you may not use or access this website.

Company Information

Manx National Heritage is the Registered Business Name of the Manx Museum & National Trust which operates under its own Act of Tynwald and is Registered Charity No. 603 in the Isle of Man. VAT registration number 000 115 367.

VAT

All prices quoted include VAT at prevailing times, where applicable.

Customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be. Please consult your local customs office for more information or the Customs Department at the Isle of Man Government +44 (0) 1624 685685.

PRICE

All prices are quoted in Great Britain Pounds and are inclusive of VAT (as may be prescribed by law from time to time), unless otherwise stated.

Post and packing prices will be charged in addition to the price of any goods.

We always try to make sure that the prices on our website are accurate but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contract details you supply us with. We will then give you the option of reconfirming your order at the correct price or cancelling it (If we are unable to contact you we will treat the order as cancelled). If an order is cancelled, any payment made for the products will be refunded in full.

PAYMENT

Online payment will be provided in a secure environment. Payments must be made in Great Britain Pounds and by any one of the payment credit or debit cards accepted by PayPal. We use PayPal as our exclusive payment processing partner to handle your payment card details. PayPal protects your financial information with industry-leading security and fraud prevention systems and none of the financial details you submit to PayPal during the payments process are revealed to us or stored by us.

AVAILABILITY

We try to keep the website as up to date as possible but cannot guarantee that any particular product will always be available. If we can’t supply a product you will not be charged for it and we will refund or re-credit your account with the amount debited by us.

All offers are available while stocks last. If we are unable to supply a product you have ordered, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you the money you have paid for it, or have the opportunity to choose an alternative/similar item.

PASSING OF PROPERTY

Manx National Heritage shall retain ownership of the goods until full payment has been made by the customer and the funds have been cleared and despatched.

PASSING OF RISK

The risk in the goods shall pass to the Customer on despatch, see below.

DELIVERY

In the event of an order being lost by a third party, Manx National Heritage bears no risk once it has left its trading premises.

Where goods have been received damaged, a refund/exchange application will only be acknowledged if the goods are returned together with their original packaging within 7 days of receipt to: Manx National Heritage, Douglas, Isle of Man, IM1 3LY.

Where the goods are signed for the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been tampered with, it is their responsibility to refuse to sign for the goods.

Manx National Heritage has the right to fluctuate delivery/postage prices in proportion with their costs for shipping.

For items of higher value special delivery will be used which includes compensation options up to £2,500.

ITEMS LOST IN THE POST

If the delivery date has exceeded and you have still not received your full order please contact us at customerservices@mnh.gov.im. We will then investigate the matter; this could take up to 5 working days. Please note that we can only entertain enquiries for lost items within 30 days of despatch.

If you have returned an item to us and you have not yet received a refund within 30 working days of postage please contact us at customerservices@mnh.gov.im and we will investigate the matter further. This could take up to 5 working days. Please note that it may take your bank up to 21 working days to refund your account. We are not liable and cannot take responsibility for any bank charges that you may incur during the refund process.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

ACCEPTANCE

The customer shall inspect the goods on receipt and shall be deemed to have accepted the goods unless within 7 days after their receipt the customer shall have notified the seller that the goods are rejected (This does not however, affect the customer’s statutory rights). If no such action has been taken, Manx National Heritage shall consider the products being as described, of satisfactory quality and fit for their purposes, and may not accept any reject at a later date.

RETURN PROCEDURE

In cases where the rejection of the goods is due to a defect or discrepancy in the order, which can be shown, the customer is entitled to a full refund or replacement.

Faulty Products

  • Where there is a defect in the product purchased we will replace or refund the item if it is returned to us in its original packaging. However, we endeavour to package the products as securely as possible to ensure they arrive in good condition.
  • It must be returned to Manx National Heritage, Douglas, Isle of Man, IM1 3LY before the replacement or refund can be issued.
  • The customer must send all returns within 7 days of receipt. It is advisable that a certificate of posting and insurance is obtained.
  • We will make the refund directly to the credit/charge card used to place the original order within 30 days or earlier once we have inspected the returned item.

Refunds

  • We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item.
  • Refunds will be issued at our discretion providing you have a valid proof of purchase and goods are returned unused in their correct packaging and that we are satisfied that the item has been returned to us in the condition it was in when delivered to you.
  • If we find the item has not been returned to us in a fully resalable condition we reserve the right not to exchange or refund the item.
  • We aim to attend to all returns as soon as practically possible.
  • For the reasons of hygiene we are unable to accept returns of pierced earrings.
  • With the exception of faulty items, we cannot accept the return of certain products which have been opened and used e.g. CD’s, DVD’s or other recorded material or perishable goods.

In cases where the rejection is due to an incorrect order from the Customer or to dissatisfaction, the Customer may receive a partial refund (full refund less postage) only. Goods must be returned to Manx National Heritage before the partial refund can be issued. When returning items you are strongly advised to obtain proof of posting and insurance. We cannot accept responsibility for parcels lost or damaged in transit.

RIGHT OF CANCELLATION

Cancellations are only accepted if the Customer complies with the following cancellation procedure:

Notification of cancellation must be made in writing to sales@mnh.gov.im either prior to receipt of goods or within 7 days of the receipt of the goods.

For goods for delivery to third parties, notification of cancellation will apply as if the consumer had received the goods on the day on which they were received by the third party.

The consumer is under a duty to take reasonable care to see that the goods are received by the supplier and not damaged in transit.

A full refund will be made within 30 days. However, the purchaser will pay for the return postage of the unwanted goods. If the consumer does not comply and returns the goods at the supplier’s cost then this cost will be deducted from the amount refunded.

Items which are excluded are sealed audio and visual recordings.

Further information concerning your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm and Consumer Protection Act 1991.

PRIVACY POLICY

Any information passed through to Manx National Heritage is managed in accordance with Data Protection legislation.

Please note that credit card and debit card details are not retained.

We may collect the following information:-

  • Name and job title
  • Contact information including email address
  • Demographic information such as postcode, preferences and interests
  • Other information relevant to customer surveys and/or offers

What we do with the information we gather:-

We require this information to understand your needs and provide you with a better service, and in particularly for the following reasons:

  • Internal record keeping.
  • We may use the information to improve our products and services.
  • We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.
  • From time to time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail We may use the information to customise the website according to your interests.

We do not sell, trade or rent your personal information to other companies.

INTERNATIONAL CUSTOMER

Customers from outside the Isle of Man, UK and Channel Islands can only pay by International credit card and must pay in Great Britain Pounds. Payments by credit card are auto-converted to all currencies at current exchange rates at the time.

LAW

These terms and conditions are governed and shall be interpreted in accordance with Isle of Man Law. Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.

If you wish to complain about any matter in respect of the goods please contact customerservices@mnh.gov.im or by post to Customer Services, Heritage Shop, Manx National Heritage, Douglas, Isle of Man, IM1 3LY.

While Manx National Heritage uses reasonable endeavours to ensure that the information on this website is accurate and up to date, it does not give any warranty as to its accuracy or completeness and Manx National Heritage will not be held responsible for any errors or omissions or for the results arising from the use of such information. We take all reasonable steps to ensure a fast and reliable service. TERMS AND CONDITIONS FOR GIFT VOUCHERS

What Values of Gift Voucher can be purchased?

Gift vouchers can be purchased with a minimum value of £5 with no maximum limit.

Where can I use my Gift voucher?

Gift vouchers may be redeemed at either the Manx Museum or House of Manannan Heritage Shops. The Manx Museum and the House of Manannan are open all year round.

What can I buy with my Gift voucher?

They can be used to purchase gift items from the Heritage shops only and cannot be used to purchase admission tickets.

Can I get the cash back from my Gift voucher?

Gift vouchers cannot be returned or refunded. The balance cannot be converted back into cash.

Is there an expiry date on my Gift voucher?

Gift card vouchers are valid for 12 months.

What will happen if I return an item purchased with my Gift card voucher?

You can exchange the item for a product of the same value, as long as it is in good condition, or another gift voucher can be issued to that value, but cash refunds cannot be made. This does not affect your statutory right.

What happens if my Gift voucher is lost or stolen?

Please treat your gift voucher with care. Manx National Heritage will not accept liability for lost or stolen gift vouchers.
